Pontoon Boat Terms And Conditions

 

1. LESSEE must be at least 18 years of age to rent and operate our watercraft. 2. Acceptable Use: LESSEE agrees that he/she will be the sole operator of the craft and will use the craft in a careful, safe and conscientious manner. LESSEE shall at all times observe and adhere to any rules and guidelines posted by LESSOR, and any applicable laws and regulations. LESSEE further agrees that he/she will be solely responsible for any fees or fines incurred during the use of the craft. 3. Rules and Regulations: LESSEE acknowledges and agrees to abide by the following rules and regulations during his/her possession and/or operation of the craft. LESSEE further agrees that failure to follow these Rules and Regulations WILL result in termination of rental time and forfeiture of any deposit ·          The engine cut-off switch will be attached to the operator at all times. ·          Any speed limits and no-wake zones must be observed. Any bridges or over-passes should be considered as no-wake zones. ·          A minimum distance of 200 ft must be maintained from other watercraft, persons, objects, platforms and shore, while I the operator, have been shown the proper procedure for starting and shutting off the engine and will make sure no person is in the water within the vicinity of the pleasure craft before starting and while running the motor. ·          Operator will not use the rented boat to tow any boat, tube or skier or any other device. ·          THE BOAT NEEDS TO BE COMPLETELY FLOATING WHILE ENGINE IS RUNNING AND IN GEAR.  The propeller needs to have at least 3 feet of water clearance to the bottom before putting the engine in gear. 4. Craft Operation: LESSEE acknowledges that he/she has been instructed on the proper and safe operation of the watercraft and understands how to properly and safely operate the watercraft. LESSEE also agrees that he/she will NOT operate the watercraft unless he/she is fully prepared and capable, and has the proper safety equipment and knowledge to do so. LESSEE also agrees to ask any questions or get further training from LESSOR as needed BEFORE operating the watercraft.

5. Prohibited Activities: LESSEE acknowledges and agrees to NOT participate in any of the following prohibited activities during his/her possession and/or operation of the watercraft. LESSEE further agrees that participation in any of the following prohibited activities WILL result in termination of rental time and forfeiture of any deposit. 

·          The use of alcohol or drugs is prohibited. ·          Use of the craft for personal or commercial purposes other than personal recreation is prohibited. ·          Use of the craft after dusk or before sunrise is prohibited. ·          Operation of the craft by anyone other than the LESSEE is prohibited. ·          Standing or walking on the watercraft while it is moving is prohibited ·          Exceeding the number of people or weight limits listed on the capacity plate is prohibited. ·          Littering is prohibited. ·          Using the craft for an illegal purpose or in an illegal manner is prohibited. ·          Using the craft in any race, test or contest is prohibited. ·          Walking or sitting outside of the gated area is prohibited while the craft is in motion. ·         Fishing while the boat is in motion is prohibited.  PETS are Prohibited  6. Operating area: The designated operating area for Wake Makers rental fleet begins at Christopher Run and continues from Christopher Creek to the North Anna River. It continues along the North Anna River to the 208 bridge. This is the southernmost point that can be accessed on our craft. To the North the operator can travel past the State Park, past Jetts Island to the 612 Bridge, never crossing under the bridge. Returning to Christopher Run the operator can travel past Christopher Creek on the North Anna River to the next 522 Bridge. Any craft found to be traveling past this designated area will be found to be in breach of this agreement and must return immediately to Wake Makers resulting in termination of contract and forfeiture of security deposit. 7. Operator Condition:  Operator must be in good physical and mental condition to operate or use the watercraft including but not limited to basic waterway knowledge & safety use, legal age, no injuries, pregnancy or intoxication from drugs or alcohol. 8. Inspection: LESSEE acknowledges having personally inspected the craft prior to use and finds it to be fully functional and ready for use and agrees to return both craft and equipment in the same condition in which it was released to them. 9. Equipment Malfunction: If the watercraft should malfunction or become inoperable, the LESSEE agrees to notify a representative of Wake Makers, LLC immediately. 10. Accident and/or Injury Notification: LESSEE agrees to immediately notify a representative of Wake Makers, LLC in the event of any accident or injury. 11. Inclement Weather: LESSEE agrees that he/she will return all equipment immediately in the event rain showers, thunderstorms or other inclement weather should arise, as these weather conditions constitute a safety hazard to the operator, passengers and the equipment. LESSOR reserves the right to cancel this rental agreement due to inclement or impending bad weather. Cancellations or early returns do not constitute any refund of fees and any refunds or rain checks given are purely at discretion of LESSOR. 12. Refueling: LESSEE agrees to return the watercraft with a full tank of unleaded gasoline. Failure to do so will result in an additional charge of the cost of the gasoline to fill the tank plus a $25.00 service fee. 13. Late Returns: Crafts returned past the agreed upon return time will be assessed a $50 late fee for the first 15 minutes they are late, each additional minute after 15 minutes will be assessed a fee of $3.50 per minute. The official time is to be designated by representatives of Wake Makers, LLC. The terms and conditions contained herein and as posted in the office, on the watercraft and/or the grounds by the LESSOR are for the safety and welfare of all who use the facilities. The LESSEE certifies that he/she has read and understands said terms and conditions, and further assumes the responsibility to see that his/her family and/or guest(s) will also obey these terms and conditions.      

CONDITIONS UNDER WHICH EQUIPMENT IS RENTED

The undersigned, lessee, hereby acknowledges receipt of the afore mentioned equipment rented this day from Wake Makers LLC, at the rental agreed to, subject to all terms and conditions of this contract agreement. Lessee also agrees not to participate in the use of the stated equipment unless he/she understands the instructions on its safe use, as given by Wake Makers, LLC and in other safety material. Lessee is also responsible for stated equipment while the lessee's additional participants are using it. It is the sole responsibility of the lessee to assure that all additional participants sign the contract where indicated and that the participants are also properly instructed on the equipment before use. Lessee is also responsible to assure that no additional participants under the age of eighteen (18) will operate the equipment. There are no other oral or written representations not included herein.

My signature below is acknowledgement that I understand equipment damage(s) is my sole responsibility. I am liable for any and all damages to the equipment. I am responsible for the cost of repair and/or replacement resulting from any loss, theft, damages, or destruction of the equipment I am renting. I agree to pay a lost revenue charge of $300 per day on equipment that is taken out of service, in addition to the cost incurred for the repair or replacement of the equipment. I agree to pay an estimated lost revenue charge and amount for the repairs on the day of damages.  I willfully have given my credit card to be copied and to be charged for any damages and or loss of revenue, my signature below authorizes these transactions.  Wake Makers, LLC reserves the right to seek legal action against me and I will be responsible for all legal fees and costs incurred to Wake Makers, LLC.
